Terms Of Service

1.1. This User Agreement (hereinafter - Agreement) applies to Advertum Internet resource site Advertum.com and all related sites linked with advertum.com.

1.2. Advertum Internet resource site (hereinafter - Site) is a property of Advertum Tech OÜ.

1.3. This Agreement regulates relations between the Administration of "Advertum" ("Site Administration") and User of this site.

1.4. Administration reserves the right to change, add or delete clauses of this Agreement at any time without notice to User.

1.5. Continued use of the site by User means acceptance of the Agreement and changes made to this Agreement.

1.6. User is solely responsible for checking this Agreement for changes in it.

2.1.1. the terms listed below have the following meaning for the purposes of this Agreement:

2.1.1 "Advertum" - an Internet resource located on the domain name advertum.com, carrying out its activities through the Internet resource and related services.

2.1.2. Internet resource - a site containing information about Goods, Seller, allowing to choose, order and (or) purchase Goods.

2.1.3. Site Administration - authorized employees of Advertum Tech OÜ who act on behalf of Advertum Tech OÜ.

2.1.4. User of Website (hereinafter User) - a person accessing and using the site through the Internet.

2.1.5 Website Content (hereinafter Content) - protected results of intellectual activity, including texts of literary works, their titles, prefaces, abstracts, articles, illustrations, covers, musical works with or without text, graphic, text, photographic, derivative, composite and other works, user interfaces, visual interfaces, trademark names, logos, computer programs, databases, as well as design, structure, selection, coordination, appearance, general style and layout included on the Site and other intellectual property objects all together and/or separately contained on the Internet resource.

3.1. The subject of this Agreement is to provide the User of the Internet resource access to the Goods and services contained on the Site.

3.1.1. The online resource provides the user with the following types of services:

•   • access to electronic content on a free basis, with the right to purchase (download), view the content;
•   • access to the search and navigation tools of the Internet resource;
•   • enabling the User to post messages, comments, reviews of Users, rating the content of the Internet resource;
•   • access to information about the Goods and to information about purchasing the Goods on a free-of-charge basis;
•   • other types of services realized on the pages of the Internet resource, including paid services.

3.1.2. This Agreement covers all existing (actually functioning) at the moment services of the Internet resource, as well as any subsequent modifications and additional services of the Internet resource appearing in the future.

3.2 Access to the Internet resource is free of charge.

3.3. This Agreement is a public offer. By accessing the site, User is deemed to have acceded to this Agreement.

4.1. The site administration has the right:

4.1.1. Change the terms of use of the Site, as well as change the content of this Site. Changes come into force when the new version of the Agreement is published on the Site.

4.1.2. Restrict access to the Site if the User violates the terms of this Agreement.

4.1.3. Change the amount of fees charged for providing access to the use of the Internet resource site. Changes in fees will not apply to Users who are registered at the time the fee is changed, except as specifically provided by the Administration of the website.

4.1.4. Collect, analyze, use, share (including on a paid basis) information about the User contained on the Site, including, but not limited to, information about the contact and personal data of the User, information about the User's actions on the Site, etc.

4.2. The user has the right to:

4.2.1. Gain access to use the Site.

4.2.2. Use all services available on the Site, and purchase any Goods offered on the Site.

4.2.3. ask any questions about the services of the Web resource at the details, which are in the "Advertum" section of the site.

4.2.4. Use the Site solely for the purposes and under the procedure specified in the Agreement and not prohibited by the law.

4.3. The Site User undertakes:

4.3.1. Provide additional information upon request of the Site Administration that is directly relevant to the services of the Site.

4.3.2. when using the site observe moral and non-property rights of authors and other right owners.

4.3.3. not take any actions that could be deemed to disturb the normal functioning of the site.

4.3.4. not use the site to distribute any confidential information about individuals or legal entities.

4.3.5. Avoid any actions that could result in violation of privacy of information.

4.3.6. not use the Site to distribute information of advertising character, unless with the consent of the Administration.

4.3.7. not use the site services for the following purposes:

4.3.7.1.

4.3.7.1. download content that is illegal, violates any rights of third parties; advocates violence, cruelty, hatred and/or discrimination on racial, national, gender, religious, social grounds; contains false information and/or insults to specific individuals, organizations or authorities.

4.3.7. 2. incitement to commit unlawful acts, and assistance to persons whose actions are aimed at violating the restrictions and prohibitions.

4.3.7. 3. violating the rights of minors and/or harming them in any way.

4.3.7.5. representing themselves as another person or representative of an organization and/or community without sufficient authority, including the employees of the Web site.

4.3.7.6. misrepresenting the properties and characteristics of any Product in the catalog of the Web site.

4.4 The User shall not:

4.4.3. By any means circumvent the Site's navigation structure to obtain or attempt to obtain any information, documents or materials through any means not specifically provided by the services on the Site;

4.4.5. Break the security or authentication system of the Site or any network connected to the Site.

4.4.6. Perform reverse searches, track or try to track any information about any other User of the Site.

4.4.7. Use the Site and its Content for any purposes, and incite any illegal activity or other activity that violates rights of the Site or other persons.

5.1. The Site and the Content included on the Site is owned and operated by the Site Administration.

5.2. Content on the Site may not be copied, published, reproduced, transmitted or distributed in any way, or posted on the World Wide Web without prior written permission of the Site Administration.

5.3. The Site Content is protected by copyright, trademark law and other rights related to intellectual property and unfair competition law.

5.4. Some services on the site may require the User to create an account.

5.5.5 The User is personally responsible for maintaining the confidentiality of the account information, including the password and any and all activity on behalf of the User in the account.

5.6 The User must immediately notify the Site Administration of any unauthorized use of their account or password or any other breach of security.

5.7. The Site Administration has the right to unilaterally terminate User's account if it has not been used for over 3 (three) consecutive calendar months without notice to User.

5.8. This Agreement applies to all additional terms and conditions for purchase of Goods and services provided on the Site.

5.9. Information posted on the Site must not be construed as an amendment to this Agreement.

5.10. Administration of the site has the right to change the list of Goods and services offered on the site and (or) prices applicable to such Goods and (or) services provided by the site at any time without notice to User.

5.11. Documents specified in paragraphs 5.11.1 - 5.11.4 of this Agreement regulate in their part and extend their effect on use of the site by User. The following documents are included in this Agreement:

5.11.1. Privacy Policy;

5.11.2. Distance purchase agreement;

5.11.3. Order form;

5.11.4. Suggestions and comments.

5.12. Any of the documents listed in paragraph 5.11. of this Agreement may be subject to updates. Changes shall become effective as soon as they are posted on the Website.

6.1 Any damages that the User may suffer due to willful or negligent violation of any provision of this Agreement, as well as due to unauthorized access to communications of another User will not be compensated by the Site Administration.

6.2. The Site Administration is not responsible for:

6.2.1. delays or failures in transactions resulting from force majeure and any failure of telecommunications, computer, electrical or other related systems.

6.2.2 The actions of money transfer systems, banks, payment systems and delays connected with their work.

6.2.3. The proper functioning of the site if the User does not have the necessary technical means to use it and has no obligation to provide users with such means.

6.2.4. The content (information) on the site.

6.3. User is solely responsible for interpretation and use of content (information) posted on the site.

7.1. Site Administration has the right to disclose any information collected about the User of this site if the disclosure is necessary in connection with an investigation or a complaint about the misuse of the site or to establish (identifying) User, who may violate or interfere with the rights of the Administration or other users of the Site.

7.2. Site Administration has the right to disclose any information about the User, which it considers necessary to comply with the provisions of applicable law or court decisions, enforce the terms of this Agreement, protect the rights or safety of the organization, Users.

7.3. Site Administration has the right to disclose information about the User, if the current legislation requires or permits such disclosure.

7.4 The Site Administration may terminate and/or block access to the Site without notice to the User if the User has violated this Agreement or the terms of use of the Site contained in other documents, or if the Site is terminated or due to a technical failure or problem.

8.1. In the event of any disagreements or disputes between the Parties to this Agreement, a mandatory condition prior to recourse to the court is the submission of a claim (written offer of voluntary settlement of the dispute).

8.2. The recipient of the claim shall, within thirty (30) calendar days of its receipt, inform the claimant in writing of the outcome of the claim.

8.3. If the dispute cannot be resolved voluntarily, either Party shall have the right to apply to court for protection of its rights, which are granted by law.

8.4 Any claim regarding the terms of use of the Site must be made within the period after the grounds for the claim arose, except for copyright protection of legally protected materials on the Site. If the terms of this paragraph are violated, any claim or cause of action shall be barred by the statute of limitations.

9.1 The Site Administration does not accept counter offers from User regarding changes to this User Agreement.

9.2 User feedback posted on the Site is not confidential and may be used by the Site Administration without restriction.
